RECRUITMENT AND SELECTION PRIVACY POLICY

1. Scope of the policy

This privacy policy ("Policy") defines the information that Pestana Hotel Group, as data controller, collects from you in this scope, the purposes for which such data is collected, the basis on which data is processed, the way data will be held and who can access the data.

2. Purpose of this platform

The present recruitment platform is exclusively used for recruitment and selection processes, for the several companies and establishments of the Pestana Hotel Group, directly or indirectly.

3. Purpose and legitimacy of the collection of personal data

The personal data processed has as sole and exclusive purpose the recruitment and selection of candidates.
The treatment of your personal data and the possibility of transferring your personal data to other Pestana Hotel Group companies, are legitimized by Article 6 (1). (b) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, as these are the pre-contractual arrangements requested by the applicant.

4. Responsible for the processing of personal data

Your data will be handled by the Human Resources team of the Pestana Hotel Group. The data  here provided will be accessible to other employees of the Pestana Hotel Group, responsible for the recruitment according to the opportunities and offers under way, but always in strict compliance with the principle of the need to access data, in order to fulfill the purposes of recruitment.

5. How is your personal data protected?

The Pestana Hotel Group has implemented all appropriate technical and organizational measures to ensure a level of safety adjusted to the risk. It is for this reason that our Personal Data is protected whenever necessary and, depending on the importance of the information, by appropriate security systems, such as pseudonymization, encryption, password protection, restricted and registered access, rigorous security policies or any other useful means to ensure the confidentiality, integrity, availability and resiliency of your data.

More generally, we strictly apply the "need to know" principle. We have entered into strict confidentiality agreements, as well as rigorous agreements with our subcontractors including all the necessary clauses for the protection of your data.

6. Data transfer

The candidate has three options regarding the visibility and availability of his or her candidate profile:

i) I want my application to be considered for all the opportunities of Pestana Hotel Group, in any country.

ii) I want my application to be considered for all the opportunities of Pestana Hotel Group, only in the selected country.

iii) I want my application to be considered only for the selected opportunities.

It is expressly clarified that, if the applicant chooses the option referred to in (iii), his data will be exclusively available to those responsible for the recruiting of the opportunities for which the applications were submitted.

It further clarifies that, if the applicant chooses the option referred to in (ii), the latter expressly authorizes the data provided by him to be provided to all Pestana Hotel Group companies responsible for opportunities advertised on the platform, but only for the selected country.

It is also clarified that if the option selected by the applicant is the option (i), the applicant authorizes his or her data to be provided to all companies and establishments of the Pestana Hotel Group responsible for opportunities announced on the platform, regardless of the country to which those opportunities relate.

The Pestana Hotel Group undertakes to ensure that, in the event of transfers of personal data to countries outside the European Union, the applicable legal provisions are observed, in particular the determination of the suitability of such country for the data protection and the requirements applicable to such transfers.

7. Applicant's rights

The applicant may at any time and for free, exercise his or her rights of access, rectification or deletion of data, opposition, limitation and portability of his or her data, through the email address dpo@pestana.com or by registered letter to the Pestana Hotel Group, Rua Jau, n.º 54, 1300 - 314 Lisboa, who acts as data controller.

8. Applicant's Obligations

The candidate must use the platform in a serious and responsible manner, being entirely responsible for correcting and updating the information provided, which must be true.

9. Type of data collected

Pestana Hotel Group only requests, in this context, the provision of relevant data for the purposes of recruitment and selection, excluding any other type of data, such as those relating to, e.g., the applicant's state of health, his or her philosophical or political beliefs, political affiliation or trade union membership, religious faith, private life and racial or ethnic origin.

10. Retention period

The data received will be kept by the Pestana Hotel Group, who will use them for recruitment purposes only, for a period of 5 years after they are received.
